Terms of Service — OpsTrove
Draft v1 · Effective date: October 3, 2026 · Pending qualified legal review
These Terms of Service ("Terms") govern your access to and use of the OpsTrove platform and its products, including WaterTrove (the "Service"), operated by Muhammad Usman Akhtar (sole proprietor), Bahawalpur, Punjab, Pakistan ("OpsTrove", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Definitions
- Subscriber: the business that opens an OpsTrove account and pays the subscription. "You" in these Terms usually means the Subscriber.
- Staff: people you invite into your account, with the roles you assign them.
- Portal customer: an end customer of yours who accesses the view-only Customer Portal.
- Customer Data: all data you and your Staff store in the Service, including data about your customers.
2. The Service
OpsTrove is a subscription business-operations platform. WaterTrove is its first product, built for water supply and delivery businesses (customer records, billing periods, deliveries, collections, expenses, payroll, assets, reports, and a view-only Customer Portal).
The Service is currently offered as an early-release ("pilot") product: it is actively developed and improved, and features may evolve. We aim to keep changes compatible and will not remove core functionality you rely on without reasonable notice.
3. Accounts and eligibility
- You must be a business or an adult acting for one. One account per business; the person who opens the account is its owner.
- Plans include a fixed number of Staff seats (the entry plan includes 5). You are responsible for everything done under your account, including by your Staff.
- Portal customers receive access only through your invitation (invite link, bill QR link, or an access request you approve). You are responsible for verifying that portal access is granted only to your genuine customers, and for the accuracy of the Customer Data shown to them.
- You must keep credentials confidential and notify us promptly of any unauthorized use at [email protected].
4. Subscription, billing, and trial
- New subscriptions start with a 14-day free trial. No charge is made for the trial; if you do not subscribe at the end of the trial, access to write features is suspended (your data is retained per Section 13).
- Paid plans start at PKR 999 per month, billed monthly in advance. Current plan prices and limits are shown on the website or your invoice.
- During pilot, fees are invoiced by us and settled by the payment method stated on the invoice. Subscription fees are exclusive of any taxes; if taxes become applicable they will be added or disclosed at that time.
- We may change prices with at least 30 days' notice; changes apply from your next billing period.
5. Refunds and credits
- Subscription fees are non-refundable for the current billing month, including partial months and unused time, except as stated below.
- If we terminate your subscription without cause, we refund the prepaid, unused portion of the current billing period.
- If the Service is unavailable due to a platform fault on our side for more than 48 consecutive hours during a paid period, you are entitled, on request, to a service credit equal to the affected days, applied to your next invoice. Credits are the primary remedy for availability issues and are not convertible to cash, except where required by law.
6. Acceptable use
You agree not to: misuse the Service (including by probing, scanning, or attempting to breach security or rate limits); store unlawful, defamatory, or infringing content; impersonate others; send unsolicited bulk messages through the Service; resell the Service without our written consent; or use the Service in violation of applicable law. We may suspend accounts that violate this section, with notice where practicable.
7. Your data
- You own your Customer Data. We process it only to provide the Service and as described in our Privacy Policy.
- You can export your data at any time using the built-in export.
- You are responsible for having the right to store the personal data you enter about your customers and staff, and for the accuracy of bills and records the Service generates from your inputs.
- We maintain daily encrypted backups (30-day retention) as a platform safeguard; backups are not a substitute for your own records.
8. Availability and support
- We target high availability but provide the pilot Service on a reasonable-efforts basis; no formal uptime SLA applies yet. Planned maintenance is scheduled off-peak where possible.
- Support is available at [email protected]; we aim to respond within 2 business days. For subscription and invoice questions, contact [email protected].
9. Warranties disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We warrant that we will provide the Service with reasonable skill and care.
10. Limitation of liability
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of data beyond our published backup commitments.
- Our aggregate liability arising out of or relating to the Service is capped at the total fees you paid us in the 3 months preceding the event giving rise to the claim (or, during the trial, PKR 0).
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (including for death or personal injury caused by negligence, or for willful misconduct).
- We are not liable for failures caused by events beyond our reasonable control (force majeure), including failures of third-party hosting, network, or messaging providers.
11. Indemnity
You will indemnify and hold us harmless from claims, losses, and expenses arising out of: your Customer Data (including data you store about your customers and staff), your misuse of the Service, or your breach of these Terms.
12. Portal customers
Portal access is provided to your end customers as a convenience on your behalf. Portal customers do not pay us and are not our subscribers; their access may be granted, suspended, or revoked by you (or by us on your behalf or for security reasons). The information shown in the portal is generated from your Customer Data.
13. Term and termination
- These Terms apply while you use the Service. You may cancel at any time; cancellation takes effect at the end of the paid period.
- We may suspend or terminate accounts for breach of these Terms (with notice where practicable) or for non-payment after a grace period of 15 days from a failed or missed payment.
- On termination you have a 30-day export window (read/export access). After that, account data is deleted; encrypted backup copies expire within the 30-day backup rotation.
14. Governing law and disputes
These Terms are governed by the laws of Pakistan. The courts of Bahawalpur, Punjab, Pakistan have exclusive jurisdiction, except where mandatory law provides otherwise.
15. Changes and contact
We may update these Terms; material changes will be notified by email or in-product notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
